The private information required for executing the orders placed through the e-commerce facility, namely the User's / Advertiser's personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by Caxtons and not sold or made known to third parties. Only the necessary information will be made known to third parties delivering the product. Credit card details are not kept by Caxtons under any circumstances.
Caxtons will not be held responsible for security breaches occurring on the Advertiser’s electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User / Advertiser may inadvertently have installed on his/her device.
Caxtons absolves itself from any indirect or consequential loss, damage or inconvenience whatsoever or however caused to any Advertiser or User of the website, as a consequence of any failure on behalf of Caxton or any of its employees, agents, representatives or contractors to fulfil any of its obligations in terms hereof or as a consequence of any errors or omissions in any advertisement and further, Caxtons is hereby indemnified against any such loss, damage or inconvenience occasioned to Advertisers and/or any of its employees, agents and/or any third parties in this regard. The user hereby indemnifies and holds Caxtons harmless against any loss, injury or damage which may be sustained as a result of using this product.
Caxtons shall not be held responsible for any loss or damage caused by any theft, hijacking, or any other physical or proprietary damage caused to the individual or the motor vehicle or any other criminal offence conducted by any party , in the execution of a sale, test drive or any other intended transaction between the parties involved.
All intellectual property rights (including, without limitation, patents, copyrights, design rights, registered design, trade and service marks, and rights to apply for any of the foregoing) whatever and wheresoever subsisting in or to any inventions, ideas or information or in or to any service, goods or works (including, without limitation, drawings, sketches, artwork, typography and photographs) invented, devised, made, created acquired or written by or for Caxtons (whether or not in connection with any contract with the advertiser) shall be and remain Caxtons absolute property. Neither the Advertiser nor any other person shall have any license or other rights whatsoever under or in respect of the said intellectual property rights. The advertiser undertakes that it will not reproduce or authorise or procure any other person to reproduce or authorise or procure any other person to reproduce any of the said artwork, typography, photographs or other works. The advertiser hereby assigns all its rights (in any) in and to the said intellectual property rights to Caxtons.
Caxtons reserves the right to make any changes to the Website, the Content, or to products and/or services offered through the Website at any times and without notice. All rights in and to the Content is reserved and retained by Caxtons. Except as specified in these Terms and Conditions, the User is not granted a license or any other right including without limitation under Copyright, Trademark, Patent or other Intellectual Property Rights in or to the Content.
Caxtons shall not be liable to a person or entity for any claim of whatsoever nature, howsoever arising pursuant to the sale and/or purchase by its Users of any motor vehicles on this website.
Credit Card Acquiring – Payment Gateway
Credit Card Transactions are acquired by MyGate Communications (Pty) Ltd, a registered systems operator and payment gateway in South Africa. Card Holders may go to www.mygate.co.za to view MyGate’s security policy.
Refund and Return Policy
The provision of goods and services is subject to availability. In cases of unavailability, the provider will refund the client in full within 30 days. Cancellation of orders by the User / Advertiser will attract a 5% charge for administration costs.
Caxtons reserves the right to cancel an order for which payment has already been received. This may occur if stock is insufficient or the quality of goods ordered does not meet Caxtons standards. Should Caxtons exercise this right, the User / Advertiser will receive a full refund with no deductions. Refunds of orders will attract a 5% charge for administration costs.
Should the User / Advertiser make a duplicate payment, the User / Advertiser will be entitled to a refund on the condition that proof of the duplicate payment is furnished to Caxtons in the form of a bank statement. Upon receipt of this proof, Caxtons will pay the refunded amount to the User / Advertiser less 5% of the refund which will be retained as an administrative cost charged to the User / Advertiser.
Any complaints regarding the standard and quality of the product or products bought by consumers through the e-commerce facility should be directed to the Marketing Manager.
Privacy: casual surfing
The User / Advertiser may visit the Website without providing any personal information. The Website servers will in such instances collect the IP address of the User / Advertisers computer, but not the email address or any other distinguishing information. This information is aggregated to measure the number of visits, average time spent at the Website, pages viewed, etc. Caxtons uses this information to determine use of the Website, and to improve Content thereon. Caxtons assumes no obligation to protect this information, and may copy, distribute or otherwise use such information without limitation.
Choice of Law
This Website is controlled, operated and administered by Caxtons from its offices within the Republic of South Africa. If the User accesses this Website from locations outside of South Africa, that User / Advertiser is responsible for compliance with all local laws. These Terms and Conditions shall be governed by the laws of the Republic of South Africa, and the User / Advertiser consents to the jurisdiction of the Witwatersrand High Court in the event of any dispute. If any of the provisions of these Terms and Conditions are found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue in full force and effect. These Terms and Conditions constitute the entire agreement between Caxtons and the User / Advertiser with regard to the use of the Content and this Website.
Updating of these Terms and Conditions
Caxtons reserves the rights to change, modify, add or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the User’s / Advertiser's obligation to periodically check these Terms and Conditions at the Website for changes or updates. The User’s / Advertiser's continued use of this Website following the posting of changes or updates will be considered notice of the User’s / Advertiser's acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.
